CADE approves new standard on association contracts

Brazil's market regulator, the Administrative Council for Economic Defense (CADE) approved the order about the Resolution 17, that mentions associative contracts, reported the institution on October 18, 2016. According to the publication, the standard regulates the cases of notification of associative contracts provided in section IV, article 90 of Brazilian Law 12.5291 / 11, and revoke Cade's Resolution 10. Associative contracts last less than two years to establish a joint venture for the operation of an economic activity.

O Conselho Administrativo de Defesa Econômica (CADE) homologou o despacho que trata da Resolução 17, sobre contratos associativos, segundo publicou a própria instituição em 18 de outubro de 2016. De acordo com a publicação, a norma disciplina as hipóteses de notificação de contratos associativos previstas no inciso IV do artigo 90 da Lei 12.5291/11, além de revogar a Resolução Cade nº 10. Os contratos associativos são aqueles com duração igual ou superior a dois anos que estabeleçam empreendimento comum para exploração de atividade econômica. |
